Union Minister Ashwini Vaishnaw Affirms No ‘Creamy Layer’ Provision for SC/ST Reservations

Union Minister Ashwini Vaishnaw has reaffirmed the government’s commitment to the reservation principles established by Dr. B.R. Ambedkar, following a recent Supreme Court ruling on SC and ST reservations. Speaking to the media, Vaishnaw addressed the key points discussed during the latest Cabinet meeting on the subject.

“The Supreme Court has delivered a judgment concerning reservation policies and suggested changes related to SC and ST reservations. Today, the Cabinet held a detailed discussion on these matters,” Vaishnaw said.

He emphasized that under the Constitution as framed by Dr. Ambedkar, there is no provision for a ‘creamy layer’ within the SC and ST reservation categories. “The NDA government remains bound by the Constitution formed by Dr. Ambedkar. According to this Constitution, SC and ST reservations do not include a creamy layer provision,” he added.

Vaishnaw’s comments are a response to ongoing debates and legal interpretations surrounding the application of reservations for Scheduled Castes (SC) and Scheduled Tribes (ST). The recent Supreme Court judgment has spurred discussions on whether the inclusion of a creamy layer—typically used to exclude more affluent individuals from reservation benefits—should apply to these categories.

The Union Minister’s statement reinforces the government’s position that the existing framework for SC and ST reservations, as envisioned by Dr. Ambedkar, remains in place. This stance aims to ensure that reservation benefits continue to serve the intended purpose of aiding the most disadvantaged within these communities, without distinguishing based on economic status.

The discussions in the Cabinet and the minister’s remarks highlight the government’s commitment to upholding constitutional principles while addressing contemporary issues related to reservation policies. The clarity provided by Vaishnaw is expected to guide future policymaking and legal interpretations regarding SC and ST reservations.
